The individual convicted of fraud is the only household member disqualified. Other household members may remain eligible.
When applying the disqualification penalty:
- The disqualified individual's financial needs are removed,
- Income and assets of the disqualified individuals continue to be considered when determining eligibility and the benefit amount for the remainder of the household, and
- The income disregards continue to apply to the disqualified individual income when determining if the remaining household members are eligible.
Overpayments are recovered through a reduction of the Total TANF Standard of Need including $45 OH allowance and special items of need. The rate of recovery for Intentional Program Violations is 20%.
